It is with an overwhelming sense of sadness and profound grief that I share the heartbreaking news of the passing of Benjamin “Ben” Maxell, a dear friend, a respected colleague, and a fellow Creighton Law School graduate. Ben passed away unexpectedly, and while the circumstances surrounding his death remain unclear at this time, the loss of such a vibrant, intelligent, and compassionate soul has left a void that cannot be easily filled. For those who had the privilege of knowing Ben, it is difficult to put into words the impact he had on all of us. Ben was not only an exceptional attorney, but he was also a wonderful human being, whose kindness, generosity, and sense of humor touched everyone he encountered. His passing is a loss not only to his family and close friends but also to the broader community that he so selflessly served during his time here.
Ben graduated from Creighton University School of Law in 2013, where he was known not only for his academic excellence but also for his leadership skills and deep empathy for others. As a law student, Ben made an indelible mark on those around him with his intelligence and dedication to his studies, always striving to better understand the law and its power to bring about positive change. He was the type of student who was always willing to lend a hand to classmates, whether through late-night study sessions, reviewing case notes, or providing words of encouragement when needed. His passion for justice and helping others was evident in every aspect of his life.
After earning his J.D. from Creighton, Ben pursued a career in law with the same commitment and heart that he demonstrated throughout his academic life. He worked at Maxell & Associates, a law firm where he contributed significantly to the firm’s success, specializing in corporate law and legal consulting. Ben’s work was always marked by his tireless attention to detail, his relentless pursuit of fairness, and his unyielding advocacy for those he represented. His colleagues respected him for his professionalism, integrity, and for being a true team player. His work ethic, however, was not just about achieving success, but also about leaving a positive impact on everyone he encountered.
Outside of his professional life, Ben was known for his sense of humor and his ability to make friends effortlessly. His laughter was infectious, and his positive energy seemed to brighten any room he entered. He had a remarkable ability to connect with people from all walks of life, and his friendship was something that many treasured. Whether it was over coffee at a local café, a long conversation about life, or during one of his memorable gatherings with friends, Ben’s warmth and generosity left a lasting impression on everyone.
Ben also had a strong sense of social responsibility. He was involved in numerous volunteer efforts, always seeking ways to give back to his community. His commitment to justice extended far beyond his professional work—he was actively involved with local nonprofits and regularly volunteered his time to help those in need, particularly in the areas of education and community development. Ben believed in using his talents for the greater good, and he embodied the very principles of service and compassion. While Ben’s career and contributions were impressive, it was his personal qualities that truly set him apart. He was an incredibly kind and loyal friend, always willing to listen and offer support when needed.
Ben had an uncanny ability to make you feel heard and understood, no matter what challenges you were facing. He had a heart full of empathy, and whether you were celebrating an accomplishment or going through a difficult time, Ben was always there, offering his encouragement and positivity. Ben was also a loving son, brother, and family member. His family meant everything to him, and he was proud of the relationships he had with his parents, siblings, and extended family. Ben often spoke with admiration about the values that his family instilled in him—values of hard work, integrity, and service to others—and he lived these values every day.
In the wake of his passing, those who were fortunate enough to know Ben will forever cherish the memories of his friendship, his laughter, and his unwavering support. The world feels a little dimmer without him in it, but his legacy will live on in the lives of those he touched. A memorial service to honor Ben’s life will be held at St. John’s Episcopal Church, located at 1234 Oak Street in Omaha, Nebraska, on January 10, 2025, at 2:00 PM. Family, friends, and colleagues are invited to come together to celebrate Ben’s life, share memories, and support one another during this incredibly difficult time.
In lieu of flowers, the family has requested that donations be made to the Creighton University Law School Scholarship Fund, in honor of Ben’s dedication to education and his alma mater. This scholarship will be awarded annually to a student pursuing a career in law, continuing Ben’s legacy of supporting others in their pursuit of justice and fairness. It is incredibly hard to accept that Ben is no longer with us. To his family, I want to extend my deepest condolences. Words cannot fully express the grief and sorrow we feel for your loss. Ben was a remarkable person—intelligent, driven, and compassionate—and we are all better for having known him. His memory will remain with us, and we will continue to honor the impact he had on our lives.
To Ben’s friends, colleagues, and all who were fortunate enough to call him a friend, please know that you are not alone in this moment of grief. Ben’s kindness, sense of humor, and loyalty are qualities we will carry with us always. His friendship was a gift, and his loss is one that is felt deeply by so many. We mourn together, and we will continue to celebrate the joy and love that Ben brought into our lives. Ben, we will miss you dearly. The world has lost a beautiful soul, but your spirit will live on in the many lives you touched. May you rest in peace, and may we carry your light with us in all that we do. Thank you for being a friend, a mentor, and a source of inspiration to all of us. We will never forget you.
